2. Your Content: Input, Output, and Ownership
This section addresses the crucial legal uncertainties surrounding AI-generated content.
A. Your Input
You are responsible for all data, scripts, images, audio files, and prompts (« Input ») you provide to the Service. You represent and warrant that you own or have all necessary licenses, rights, and permissions to use the Input and that the Input does not infringe upon any third party’s rights.
B. Ownership of Output (The Videos)
Subject to your full compliance with these Terms, and your payment of all applicable fees, VideoGen AI assigns all rights, title, and interest in and to the video, audio, and visual content generated for you by the Service (« Output ») to you.

Copyright Disclaimer: You acknowledge that the legal status of copyright ownership for AI-generated works is uncertain in some jurisdictions. You accept the risk that the Output may not be eligible for copyright protection in certain territories.
C. License to VideoGen AI
You grant VideoGen AI a royalty-free, worldwide, non-exclusive license to use your Input and Output solely for the purposes of operating, maintaining, promoting, and improving the Service, including internal testing, development, and demonstrating the Service’s features. We will not use your private Output to train models for other customers without your explicit consent.
3. Acceptable Use Policy: The Deepfake and Impersonation Rule
This is a high-risk area for video AI. You agree to adhere to the following strict rules:

You may not use the Service to generate, or attempt to generate, any content that:

Non-Consensual Deepfakes: Creates videos featuring an identifiable person (including public figures, employees, or private individuals) without their explicit, verifiable, and written consent to have their likeness used.

Harmful/Illegal Content: Is illegal, abusive, harassing, defamatory, fraudulent, or promotes hate speech, violence, or discrimination.

Child Exploitation: Depicts or simulates minors in a sexual or abusive manner. We have a zero-tolerance policy and will report any suspected activity to law enforcement.

Misinformation/Fraud: Aims to deceive, mislead, or commit fraud (e.g., faking financial crime confessions or political endorsements).

Intellectual Property Violation: Infringes upon any third party’s copyright, trademark, or right of publicity.
B. Disclosure Requirement
If you publish Output intended to depict real events or real individuals (even with consent), you must clearly and conspicuously disclose that the content is AI-generated or synthetic.
C. Content Monitoring
You acknowledge that VideoGenAI uses both automated tools and human review to monitor and flag Inputs and Outputs for violations of this Policy. We reserve the right to remove any content and terminate your account immediately without refund for violations.
4. Financial Terms, Termination, and Liability
A. Fees and Payment
All Service fees are set forth on our Pricing page and are non-refundable outside of any explicit money-back guarantee provided. Subscriptions renew automatically until cancelled.
B. Account Suspension and Termination
We may suspend or terminate your access to the Service immediately, with or without prior notice, if:

C. Disclaimer of Warranty

D. Limitation of Liability
To the maximum extent permitted by law, VideoGen AI shall not be liable for any indirect, incidental, consequential, or punitive damages (including loss of profits, data, or reputation) arising from your use of the Service or the Output.
5. Governing Law and Disputes
A. Governing Law
These Terms shall be governed by the laws of the state of California, without regard to its conflict of law principles.
B. Dispute Resolution (Arbitration Clause)
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in California, USA, rather than in court. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
